Who Is Liable in a Workplace Accident?

Under California law (Section 6311), employers are required to provide a safe working environment. When a fatal workplace incident occurs:

  • Cal/OSHA investigates potential safety violations
  • The family may be entitled to workers’ compensation death benefits
  • Civil actions may be pursued if third-party negligence, defective machinery, or lack of training is involved

Losing a loved one on the job is devastating—and often preventable. Families should not have to face the legal and financial aftermath alone.
