Occupant Ejections: One of the Most Dangerous Consequences of a Rollover Crash
Rollover crashes are among the most dangerous types of roadway accidents.
When an occupant is ejected from a vehicle, the risk of:
- Traumatic brain injuries (TBIs)
- Spinal cord injuries
- Multiple fractures
- Fatal injuries
increases dramatically.
For this reason, proper seat belt use remains one of the most important safety factors in preventing catastrophic injuries.
Legal Considerations: What Investigators Are Examining
In rollover crashes like this one, investigators typically evaluate several potential contributing factors.
Possible Contributing Factors
- Excessive or unsafe speed (CVC § 22350)
- Loss of vehicle control
- Tire blowouts
- Mechanical failures
- Roadway conditions
Key Evidence
Investigators may review:
- Accident reconstruction findings
- Vehicle damage
- Skid marks
- Seat belt usage
- Witness statements
At this time, CHP has not announced an official cause of the crash.
Rights of Victims and Their Families
Even when a crash involves only one vehicle, injured victims and the families of those who lost their lives may have legal rights depending on the results of the investigation.
Potential claims may include:
✔️ Current and future medical expenses
✔️ Rehabilitation and specialized treatment
✔️ Lost income and earning capacity
✔️ Pain and suffering
✔️ Wrongful death claims (CCP §§ 377.60–377.61)
✔️ Funeral and burial expenses
If the investigation identifies mechanical defects, vehicle failures, or dangerous roadway conditions, additional parties may also be held responsible.
