Legal Considerations: Commercial Truck Crashes
Crashes involving tanker trucks or commercial vehicles are often more complex than standard collisions.
Investigations may examine:
🔹 Driver Negligence
- Unsafe speed (CVC § 22350)
- Loss of vehicle control
- Dangerous driving maneuvers
🔹 Trucking Company Liability
If the truck is operated by a company, as in this case, investigators may evaluate:
- Vehicle maintenance
- Driver training and supervision
- Compliance with federal regulations (FMCSA)
- Load conditions and tanker operation safety
Rights of the Victims’ Families
When a fatal crash involves a commercial truck, families may have the right to file a wrongful death claim under California Code of Civil Procedure § 377.60–377.61.
This may include compensation for:
✔️ Funeral expenses
✔️ Loss of income and financial support
✔️ Loss of companionship and family support
In these cases, compensation may involve high-value commercial insurance policies, especially when trucking companies are involved.
