What Is a Fatal Hit-and-Run in California?
California law requires every driver involved in a collision to:
- Stop immediately
- Provide identifying information
- Render reasonable assistance to injured persons
Leaving the scene of an accident involving injuries or death can result in serious criminal charges.
Applicable Law
California Vehicle Code § 20001
When a person leaves the scene of a collision that causes injury or death, they may face felony criminal charges.
Legal Perspective: Beyond Criminal Charges
Even when a criminal case is filed, surviving family members may also have important civil rights.
Investigations often examine:
Accident Factors
- Right-of-way during the left-turn maneuver
- The motorcyclist’s passing maneuver
- Visibility and roadway conditions
- The driver’s actions after the collision
Potential Shared Liability
California follows a pure comparative negligence system (Li v. Yellow Cab Co., 1975), meaning liability may be allocated among multiple parties depending on the facts of the case.
Rights of the Victim’s Family
When a person dies in a traffic collision, eligible family members may have the right to seek compensation through:
✔️ Wrongful death claims (CCP §§ 377.60–377.61)
✔️ Funeral and burial expenses
✔️ Loss of future financial support
✔️ Loss of companionship, care, and emotional support
✔️ Other economic damages permitted by law
If the collision involved a commercial vehicle, investigators may also examine whether the trucking company shares responsibility.

When a Commercial Truck Is Involved
Accidents involving commercial trucks often require broader investigations, including:
- Driver logs and hours-of-service records
- Driver training and qualifications
- Company safety procedures
- Vehicle inspections and maintenance records
- Dashcam footage and electronic logging systems
Early preservation of evidence can be critical.
