Sacramento Cyclist Seeks Justice after Road Rage Incident

Sacramento, California – Sherry Martinez, a Sacramento cyclist, continues to fight for justice after a suspected road rage incident that sent her to the hospital last year. The accident involved a truck driver.

According to the police, 30-year-old Kaleb Taubman intentionally drove into Martinez while she was cycling with her group on 24th Street. Taubman was arrested following the collision for assault with a deadly weapon but has since been released and is awaiting a trial date.

I’m alive, and I’m looking around, and he faces no consequences,” Martinez expressed.

The apparent road rage attack nearly cost her life. “I did about three flips on my bike and was unconscious for about 10 minutes,” Martinez recalled.

Although Martinez’s physical injuries have healed, Taubman has yet to face formal charges from the district attorney’s office.

I deserve justice, not just for me but for others who are recklessly hit by drivers who think driving is like playing Grand Theft Auto,” Martinez affirmed.

A local attorney explained that the delay in justice could be due to the collection of evidence before making a final decision. Local media contacted the Sacramento County District Attorney’s Office, which issued the following statement:

This case was presented to our office on 8/14/23. After our review, we had additional questions that needed answering before making our decision. As such, the case was rejected and referred back to the Sacramento Police Department for further investigation. At this time, we have not received any additional evidence. We will reach out to the Sacramento Police Department again for follow-up.”

On Tuesday, May 21, a spokesperson for the Sacramento Police Department indicated that no one is currently assigned to the case. However, a day later, they issued the following statement:

Officers made an arrest on the day of the incident and booked the suspect into jail for assault charges. The case was sent to the district attorney’s office for review. The DA decided not to file charges due to conflicting statements obtained at the scene.

The department added that the district attorney requested any recordings of the incident, but none were found.

Despite the accident, Martinez has returned to cycling. She never doubted getting back on her bike after her recovery, but she questions why the driver who hit her remains free. “I’d hate to see him still being able to drive and take someone’s life,” Martinez commented.

Sadly, thousands of victims in California must live with the frustrating reality of seeing their cases ignored or delayed due to a lack of evidence. However, their pursuit of justice does not allow them to give up.

At Ayuda California, we are dedicated to obtaining the justice and compensation that accident victims deserve, and we leave no stone unturned in seeking every possible means to prove the negligent actions that led to injuries and damages.
