A tragic wrong-way crash on Highway 395 left two drivers dead Sunday night near the California–Nevada state line, according to Sierra County authorities.

What Happened?

According to the Sierra County Sheriff’s Office, multiple 911 calls were received around 7:30 p.m. reporting a vehicle traveling the wrong way near the agricultural inspection station along U.S. 395.

Authorities in both California and Nevada were notified as the vehicle continued driving against traffic toward Nevada.

Minutes later, a head-on collision was reported just north of the state line.

Preliminary Details:

  • The crash involved a Subaru Impreza and a white SUV.
  • One of the vehicles caught fire after the collision.
  • One driver was trapped inside the vehicle.
  • CPR was performed on one of the drivers.
  • Tragically, both drivers were pronounced dead at the scene.

The California Highway Patrol (CHP) is leading the crash investigation, while the Sierra County Sheriff’s Office is conducting the corresponding forensic investigation.

Legal Perspective: What Happens in a Wrong-Way Crash?

Wrong-way crashes often carry a presumption of serious negligence because they violate California Vehicle Code § 21651, which prohibits driving against the flow of traffic on divided highways.

However, each case must be carefully evaluated. Investigators may consider factors such as:

  • Medical emergencies
  • Driving under the influence of alcohol or drugs (CVC § 23152)
  • Inadequate signage
  • Mechanical failures

Rights of the Victims’ Families

When a crash results in death, immediate family members may have the right to file a wrongful death claim under California Code of Civil Procedure §§ 377.60–377.61.

This may include compensation for:

✔️ Funeral expenses
✔️ Loss of future financial support
✔️ Loss of companionship and emotional support
✔️ Medical expenses incurred prior to death (if applicable)

If gross negligence is established, additional damages may also be considered.
