Rollover Crashes on Rural Roads: High-Risk Factors
Crashes on rural roads often involve:
- Sharp curves or sudden directional changes
- Limited lighting
- Uneven or gravel surfaces
- Speeding or loss of vehicle control
Rollover crashes are especially dangerous due to risk of ejection, multiple impacts and increased likelihood of fatal injuries
Legal Perspective: Single-Vehicle Accidents
Even when a crash involves only one vehicle, California law allows for a deeper analysis of potential liability.
Unsafe Driving
Investigators may evaluate:
- Unsafe speed (CVC § 22350)
- Loss of vehicle control
- Reckless driving (CVC § 23103)
Roadway Conditions
Liability may also involve dangerous conditions such as:
- Lack of warning signs on curves
- Hazardous road design
- Absence of protective barriers
In such cases, a public entity could be held responsible under California Government Code § 835.
Rights of the Family
When a fatal crash occurs, surviving family members may have the right to file a wrongful death claim, depending on the investigation findings.
Compensation may include:
- Funeral expenses
- Loss of financial support
- Loss of companionship and family support
Each case depends on specific evidence, roadway conditions, and official reports.
