Wrong-Way Crashes: Among the Deadliest Types of Collisions
Wrong-way crashes often result in high-speed head-on impacts, significantly increasing the risk of death or severe injuries.
In California, driving under the influence of alcohol or drugs is illegal under California Vehicle Code §23152, and this type of conduct can lead to both criminal penalties and civil liability.
Legal Rights of Victims and Their Families
When a fatal crash occurs due to wrong-way driving or suspected DUI, California law allows several types of legal claims to be considered.
In Fatal Cases
Immediate family members may file a wrongful death claim under California Code of Civil Procedure §377.60–377.61, which may include compensation for:
✔️ Funeral expenses
✔️ Loss of financial support
✔️ Loss of companionship and family guidance
In Cases of Serious Injury
Surviving victims may seek compensation for:
✔️ Current and future medical expenses
✔️ Rehabilitation and therapy
✔️ Lost income
✔️ Pain and suffering
If it is proven that the driver acted under the influence of alcohol or drugs, punitive damages may also be considered under California Civil Code §3294.
